Mind Over Muscle (“we”, “us”, “our”) is committed to protecting your privacy. This policy explains how we collect, use, store and disclose your personal information, and how you can access or correct it. We handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and, as a health service provider in Victoria, the Health Records Act 2001 (Vic).

The information we collect
We collect personal information you give us directly — when you book an appointment, fill in a form on our website, contact us by phone or email, or attend a consultation. This may include your name, contact details, date of birth, emergency contact, and health information relevant to your care (such as your health history, symptoms, and treatment notes). Health information is “sensitive information” under the Privacy Act, and we only collect it with your consent and where it is reasonably necessary for your treatment.

When you use our website, our servers and third-party tools may automatically record technical information such as your IP address, browser and device type, the pages you visit, and how you arrived at our site.

How we use your information
We use your personal information to provide and manage your myotherapy care, respond to your enquiries, manage bookings and payments, send appointment reminders and service updates, meet our legal and professional obligations, and improve our services. We only use your health information for purposes directly related to your treatment, or as otherwise permitted or required by law.

Advertising and cookies
Our website uses cookies and similar technologies to help it function and to understand how visitors use it. We also run online advertising through platforms such as Google Ads and Meta (Facebook and Instagram). These platforms may place cookies or tracking pixels on your device so we can measure the performance of our ads and show relevant ads to people who have visited our site (remarketing). This advertising activity does not use your health information. You can manage or disable cookies in your browser settings, and you can opt out of personalised advertising through Google Ads Settings and Meta’s ad preferences.

Disclosure of your information
We do not sell your personal information. We may share it with third parties who help us run our practice — such as our booking and payment providers, IT and website providers, and our advertising platforms — and only as needed for those services. We take reasonable steps to protect your personal information from misuse, loss, and unauthorised access, and to hold health records securely. Some of our service providers may store data on servers located overseas; where this happens, we take reasonable steps to ensure your information is handled consistently with the APPs. No transmission over the internet can be guaranteed to be completely secure.

Data breaches
If we become aware of a data breach that is likely to cause serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) in line with the Notifiable Data Breaches scheme.

Accessing and correcting your information
You can ask to access the personal and health information we hold about you, or ask us to correct it if it is inaccurate. Contact us using the details below and we will respond as soon as reasonably possible.

Children’s privacy
Where we treat clients under 18, we handle their information with the consent of a parent or guardian as appropriate.
